Terms of service

1. Who we are

Mastilo (mastilo.app) is an independent service run from Sydney, Australia (“Mastilo”, “we”, “us”). You can reach us at hello@mastilo.app. These terms are an agreement between you and us about using Mastilo. By creating an account or using the service you agree to them. If you use Mastilo for a business, you agree on behalf of that business.

2. What Mastilo does

Mastilo turns a short brief into a short animated episode: it writes a script, which you review and edit, then draws it scene by scene. Scripts, characters and drawings are produced automatically, using our own software and models provided by third parties. If you ask it to, Mastilo also reads a link you give it or looks your topic up on the web.

Automatically written scripts can be wrong, out of date or unsuitable. Review every episode before you publish or rely on it. You are responsible for what you publish.

3. Your account

You can make one episode without an account, to try Mastilo. Saving, downloading or sharing it, and making more, needs an account, and these terms apply either way. You must be at least 18, or old enough to enter a contract where you live. Keep your sign-in secure; you are responsible for what happens under your account. Tell us at hello@mastilo.app if you think someone else has used it.

4. Plans and stories

Mastilo counts use in stories. Writing a new script uses one story. For a day after Mastilo writes it, rewriting that script (the whole script or one line) is included, and so are its first three drawings. After that day a rewrite uses another story, and so does any drawing past those three. Designing a character does not use a story.

• Free: 5 stories a month. Downloaded videos carry a “Made with Mastilo” mark.
• Pro ($12/month): 30 stories a month and downloads without the mark.

Allowances reset on the first day of each calendar month (UTC). Unused stories don’t carry over. If something fails and nothing is written or drawn, the story is given back. To keep the service fair for everyone there is also a limit of 60 requests a day, on every plan.

On the Free plan you agree not to remove or hide the Mastilo mark on downloaded videos.

5. Paying for Pro

Pro is a monthly subscription in US dollars, charged in advance and renewing automatically each month until you cancel. We sell the subscription, and Stripe processes the payment for us; Stripe’s own terms also apply to the payment. The price you pay is the total shown at checkout. We never see or store your full card details.

Cancelling: you can cancel at any time from Plan & billing (“Manage subscription”). Pro continues until the end of the month you have paid for, then your account returns to Free. We don’t refund part-months, except where the law requires it (see section 10).

If a renewal payment fails, Stripe retries it for a while and Pro stays on meanwhile. If it still can’t be collected, your account returns to Free.

Price changes: we may change the price of Pro. We will tell you at least 30 days before a new price applies to you, and you can cancel before it does.

6. Your content

You keep the rights you have in what you put into Mastilo: your briefs, edits, links and any photo you upload to design a character. As between you and us, you own the scripts and episodes Mastilo makes for you, and you may use them for any lawful purpose, including commercially. Because they are generated automatically, other people may receive similar results, and we can’t promise that an episode is protected by copyright or that no one else has rights in something similar.

You give us permission to host, process and display your content only as needed to run Mastilo for you: for example, to write and draw your episodes, save them to My episodes, and play them for anyone you share a link with. A photo you upload to design a character is used for that one request and isn’t stored.

Anyone who has an episode’s link can watch it, so share links only with people you want to see the episode. You can delete saved episodes from My episodes.

You promise that you have the right to use what you upload or link to, and that your content and episodes won’t break the law or anyone else’s rights.

7. Things you must not do

• Make content that is illegal, defamatory, harassing, hateful, sexually explicit or that exploits children.
• Impersonate a real person or brand, or make episodes that mislead people about who made them.
• Upload photos of people without their permission, or infringe anyone’s copyright or trade marks.
• Get around the story limits, plans or payment, for example with several accounts, or by automating or scraping the service.
• Interfere with, overload, probe or reverse engineer the service.

We may remove content or suspend accounts that break these rules.

8. Our service

We work to keep Mastilo running and improving, but we may change, pause or stop features. We rely on other providers for sign-in, hosting, storage, payments and the models that write and draw, and the service can be interrupted when they are. If we stop offering Pro, we will stop charging you and refund any month you have paid for but can’t use.

Mastilo, its software, drawing style and brand remain ours. You may not copy or resell the service itself.

9. Ending your use

You can stop using Mastilo at any time, and cancel Pro as described above. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where we reasonably can, we will tell you first and give you a chance to download your episodes.

10. Consumer law, and our liability

Nothing in these terms limits rights you have under the Australian Consumer Law or other consumer laws that can’t be excluded, including a right to a remedy if the service has a major failure.

Apart from those rights, Mastilo is provided “as is”. To the extent the law allows, we aren’t liable for indirect or consequential loss, lost profits or lost data, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if that is more. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, it is limited to supplying the service again or paying for it to be supplied again.

11. Changes to these terms

We may update these terms. If a change matters, we will tell you in the app or by email before it takes effect. If you keep using Mastilo after that, the new terms apply; if you don’t agree, you can stop using it and cancel Pro.

12. Law and contact

These terms are governed by the law of New South Wales, Australia, and the courts there can hear any dispute, without taking away any right you have to bring a claim where you live.
